General terms and conditions for using the International Patients Portal

Preamble and Legal notices

The objective of the present General Terms and Conditions of Use (T&Cs) is to define the terms and conditions for providing the International Patients Portal, hereinafter referred to as “the Portal” and the conditions of use for the User accessing the Portal. The Portal is made available by Nantes University Hospital (CHU de Nantes), hereinafter referred to as “the Institute”, in the context of a request for non-urgent hospital treatment without financial payment covered by the French social security system or another International Agreement. All access and/or use of the Portal assumes acceptance of and compliance with all of the terms of the present Conditions on an unconditional basis. In the event that the User does not want to accept these terms and conditions of use in full or in part, they will be asked to waive their right to use the Portal. The present terms and conditions apply to the exclusion of all other conditions. They may be subject to change. The applicable conditions are therefore in force on the Portal from the first moment of using it. The Portal was designed by Nantes University Hospital and developed by Sigma.

Definitions

Portal: this Portal is a tool offered by the Institute in the context of a patient request in light of potential medical treatment at Nantes University Hospital. The portal makes it possible to:

  • send administrative information from the patient to Nantes University Hospital;
  • send the medical information needed for Nantes University Hospital to review the request;
  • receive a treatment offer adapted to the request, accompanied by a cost estimate related to the medical and hospital treatment provided by Nantes University Hospital;
  • notify Nantes University Hospital of whether the cost estimate has been accepted.
If the cost estimate sent to you is accepted, the patient’s treatment will become effective only once payment has been received within the given time frame. From this point, Nantes University Hospital:
  • will send confirmation of payment as needed for your visa application;
  • will schedule the appointment(s) mentioned in the treatment plan.
Content: all of the elements in the Portal that have been created and modified by the Institute on the day of use. Institute: Nantes University Hospital (CHU de Nantes) User: the patient treated in the Institute, who opens and uses the Portal on compatible computer equipment.

Protection of the Portal – Intellectual property

Any reproduction, modification and distribution of elements of the Portal is prohibited without prior written consent from the Institute. The labels and logos featured on the Portal, as well as medical documents, are the property of the Institute and subject to a usage licence. Any reproduction, representation, use or modification of the Portal, in full or in part, in any form this takes and on any format, is strictly forbidden and constitutes a counterfeiting offence without prior authorisation from the Institute.

Access to the Portal

The Institute grants the User a non-exclusive, personal, free and non-transferable licence to use the Portal. The Portal uses a local storage mechanism (similar to cookies) in order to keep User connection information. This mechanism is mandatory for using the Portal. The Portal is made available by the Institute and can be accessed 24/7, except for scheduled maintenance and section 6 of these T&Cs. Access to the Portal is provided on the basis of a service as it is now and that is accessible depending on its availability. The Institute does not provide any technical support service for using the Portal. In other words, the Institute does not have a dedicated hotline. Under no circumstances can the Institute or any party participating in the creation and use of this Portal be held responsible for damage caused by access to and use of this Portal, or an inability to access or use it. Under no circumstances should the collection of medical information through the Portal be considered as it being taken into account within the predefined time frames. The User must contact the Institute or the relevant public emergency service (15 or 112 in France) in the event of a medical emergency.

User commitments

The User undertakes:

  • to use the Portal only for legal purposes and under the conditions and limitations of the present general terms and conditions and without causing damage to third parties and/or the Institute.
  • to not disclose their access details for the Portal and to be the sole User for their account.
Through the use of this Portal, the User gives their consent to the present General Terms and Conditions of Use from their first connection.

Modifications to the Portal

The Institute reserves the right to make all necessary and useful modifications or improvements to the Portal and shall not be held responsible for any damage occurring as a result.

Medical data

Medical data collected by the User will be added to the patient’s medical file. This data can be accessed exclusively by the Institute and the User. The Institute cannot be held responsible for incorrect use, data loss or psychological damage when using the Portal. When using the Portal on several devices (smartphone, tablet, online), the data will be synchronised and accessible on all platforms. This data is likely to be used by the Institute only for medical or statistical purposes. Pursuant to the provisions of the French Data Protection Act (modified law of 6 January 1978) and European Regulation 2016/679 of 27 April 2016, the User has the right to the access, portability, rectification, erasure and limitation of their personal data. The User also has the right to object to the transmission of data covered by professional confidentiality that is likely to be used in the context of this Portal and to be processed. Exercising this right will lead to stopping the Portal usage licence that is granted to the User by the Institute. The User can also access, either directly or through a qualified intermediary of their choice, all of their medical information by applying the provisions of Article L. 1111-7 of the French Public Health Code (Code de la Santé Publique). These rights should be exercised towards the Institute’s management or the Data Protection Officer at the Institute (vosdonneespersonnelles@chu-nantes.fr). For any complaint related to the processing of personal data, especially their health data, the User can refer to the French National Data Protection Authority (CNIL) (https://www.cnil.fr/fr/webform/adresser-une-plainte).

The Users may be redirected to external websites by clicking on a hypertext link. The Institute cannot be held by held responsible for the content of these websites or the personal data processing policy for these other websites.

Applicable law

These terms and conditions for use of the Portal are subject to French law. In the event of a dispute, only French tribunals will be competent.
